LPD STREET CRIMES ALONG WITH ATF MAKE ARREST IN INVESTIGATION RELATED TO UNLAWFUL DEALING AND MANUFACTURING OF FIREARMS: INVESTIGATION RELATED TO THE DEATH OF DEPUTY JUSTIN DEROSIER
On November, 17, 2021 the Lower Columbia SWAT team served a search warrant at Trevor Batchelor's residence, 981 Columbia St. Cathlamet, WA. for the Longview Police Street Crimes Unit. Batchelor was safely taken into custody at this time. During the search of the residence ATF Agents and Street Crimes Detectives located hundreds of items related to the manufacture of firearms. Batchelor was transported to the Cowlitz County Jail where he was booked on RCW 9.41.190(1)(d) – Unlawful manufacture of an untraceable firearm with the intent to sell the untraceable firearm, RCW 9.41.325 (1)(a) – Undetectable or untraceable firearms, knowingly/recklessly allow/aid/facilitate/abed the assembly/manufacture by person ineligible to possess., RCW 9.41.113 (3)/RCW 9.41.115 – Failure to use dealer to facilitate transfer between two private parties.
Information developed during this investigation indicates that Batchelor unlawfully sold multiple firearm, including the gun that was used by Brian Butts to kill Cowlitz County Deputy Justin DeRosier on April 13, 2019.
Investigation Background
In March, 2018, Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) received information from a concerned citizen regarding Trevor Batchelor dealing firearms without a license.
In September, 2018, an agent with the ATF and Detectives with the Longview Police Department contacted Batchelor and explained that they knew Batchelor had been selling guns for years and that he had been caught on camera in an
undercover deal where his friend had been arrested but Batchelor had not. Batchelor was informed that recent information revealed his involvement in the unlawful distribution of firearms. ATF explained the firearms dealing without a license statute, 18 USC 922(a)(1)(A), and that ATF was serving him with a warning notice to stop those activities or face potential criminal repercussions. The letter served to Batchelor was an official warning to cease and desist engaging in the business of dealing in firearms until he sought and obtained a Federal firearms license.
On April 13, 2019, Cowlitz County Deputy Justin DeRosier was shot and killed after responding to a disabled vehicle call near the 100 block of Fallert Road, Kalama, WA. Brian Butts was identified as a suspect in the murder of Deputy DeRosier. On April 14, 2019, Butts was shot and killed during an exchange of gunfire with law enforcement in the Kalama, Washington area. Butts was armed with a Smith and Wesson 9mm pistol, model SW9VE, serial number DVV6929 when he was killed. This pistol was confirmed by the Washington State Patrol Crime Laboratory as the weapon used to kill Deputy DeRosier. Further investigation revealed that this Smith and Wesson pistol had been sold to Batchelor in January, 2017 from a local gun shop. Butts was a convicted felon and unable to lawfully purchase or possess a firearm.
In April, 2019 ATF along with Longview Police Street Crimes Unit Detectives interviewed Batchelor regarding the handgun. Batchelor reported selling the handgun to a local pawn shop. A pawn shop record check revealed this handgun never came through the business.
In August, 2020 ATF along with Longview Police Street Crimes Unit Detectives interviewed Batchelor again. When asked about the other guns Batchelor had purchased, he could not remember who he sold them to and admitted to selling firearms without a background check as required by law. Batchelor was also informed that he sold the gun that was used to kill Deputy DeRosier.
During the summer of 2020, ATF Agents with the assistance of the Longview Police Department Street Crimes Unit began working with a source who was aware of Batchelor's continued unlawful firearms activities.
ATF Agents along with Street Crimes Unit Detectives began a joint investigation into these unlawful activities. With the assistance of the source, firearms transactions were conducted which included the sale of a "ghost gun" (a gun without serial numbers). The transaction was not conducted lawfully per RCW 9.41.113 which requires background checks for the transfer. The investigation also revealed Batchelor was aware the purchaser was prohibited from possessing firearms. This investigation determined Batchelor continued to conduct unlawful firearms transfers. Detectives developed probable cause to for the
November 17 search warrant and to arrest Batchelor for multiple firearms violations.
The successful completion of this investigation is a direct result of the joint efforts of the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Longview Police Department Street Crimes Unit and the Lower Columbia SWAT Team.
"ATF takes its responsibility for regulating the firearms industry very seriously, and someone knowingly engaging in the firearms business without a license is a danger to our community," said ATF Seattle Field Division acting Special Agent in Charge Jonathan Blais. "The fact that Cowlitz County Deputy Justin DeRosier was shot and killed by convicted felon Brian Butts, with a firearm sold by Batchelor, underscores the danger of Batchelor's actions."

Must be some kind of mistake. There are laws that prevent unwanted people from getting guns. This is simply impossible. Next thing you know, they will try to make murder illegal.

We need to close the freedom loophole.
