This means I can't buy a gun in oregon period! Because I've been told repeatedly that Oregon (Capitalized because it was pre 941 Oregon) does NOT save the background check information with the serial numbers. I know the GS does, but one GS I talked to said he is really afraid there will be a fire where his records are kept when he dies or retires, but as I understand this new law the serial #s will be stored, which is CLEARLY against the INTENT of the second amendment.

The oregon police don't store the records(or say they don't) but the law says the private transaction through the FFL has to go through the normal federal rules for selling guns, which requires keeping the paperwork for X number of years. So there will be a piece of paper with your name tied to a serial number, maybe just not in the possession of the state, but somewhere they could easily get it.

I think this law will just create a 2-tier market. I can now advertise my gun as "Pre-941" and the buyer will know it was sold by a private buyer to me prior to this law, and the gov't has no way of tying it to me. This law will be ignored, just as in Colorado and Connecticut. I strongly urge those of you who will follow the rules to just buy a gun from a dealer, so hopefully next session when we can vote some more republicans in, we can point to statistics that show only 1200 private transactions under the new law, it's completely unenforceable, and get it repealed.

I didn't want to bring this up before the law passed, but couldn't you just create a trust for a gun, call it the "Colt AR-15 assault gun Trust" and add someone's name to the trust for a fee?

It hasn't passed until the governess signs it. In the meantime I just ordered a 9x18 Polish Radom to be delivered directly to my house from an out of state dealer (FFL03 on file). Thanks to Salem, I now have yet another evil gun. No background check... no backdoor registration. From their bound book to mine.

so SB941 doesn't prohibit someone with an FFL-03 from having C&Rs shipped to their homes?
 
I read it last week(I don't think they amended it at all), and I'm pretty sure it doesn't. It says they may charge a reasonable fee, but doesn't require them to help you out.

Listening to some of the legislators who were speaking against the bill, that was a point they brought up..there is no requirement

Whether or not it does is debatable. However, the crime is committed by the seller, not the buyer. If an out of state dealer chooses to ship me a gun, I as the buyer have committed no crime.

Intrastate purchases would likely be illegal and would open the seller up to criminal proceedings if caught.

Remember, this bill is not written to discourage felons from buying on the street. It was written to punish law abiding gun owners if they sell or lend to someone else without adding their gun to the non-existent registry.
 
Oregon is not a community property state. I believe family transfers are exempted under the bill anyway.

That said, UBC is a minor issue compared to having our elected officials being bought and paid for by Bloomberg to do his bidding and turn Oregon into another New York. Shame on them.
My fear is what he will try and buy next.

So, if it's signed this week, would they have to cancel the Machine Gun shoot in Albany in a few weeks? All the "transfers" that would be going on down there boggle the mind!
 
I feel really bad for the criminals wanting to get their hands on a gun. What if they get denied or have to wait? So so sad.

This law only affects law abiding citizens. So lame.
 
Ya'll better be thinking now, if it's a felony to sell the gun... what will it be if you are armed when you sell it? Follow the law if you decide to sell here in this state. It may be cheaper to send them to a FFL in another state but follow the law. You are dealing with the same socialist thinking that run Germany.
