This means I can't buy a gun in oregon period! Because I've been told repeatedly that Oregon (Capitalized because it was pre 941 Oregon) does NOT save the background check information with the serial numbers. I know the GS does, but one GS I talked to said he is really afraid there will be a fire where his records are kept when he dies or retires, but as I understand this new law the serial #s will be stored, which is CLEARLY against the INTENT of the second amendment.
The oregon police don't store the records(or say they don't) but the law says the private transaction through the FFL has to go through the normal federal rules for selling guns, which requires keeping the paperwork for X number of years. So there will be a piece of paper with your name tied to a serial number, maybe just not in the possession of the state, but somewhere they could easily get it.
I think this law will just create a 2-tier market. I can now advertise my gun as "Pre-941" and the buyer will know it was sold by a private buyer to me prior to this law, and the gov't has no way of tying it to me. This law will be ignored, just as in Colorado and Connecticut. I strongly urge those of you who will follow the rules to just buy a gun from a dealer, so hopefully next session when we can vote some more republicans in, we can point to statistics that show only 1200 private transactions under the new law, it's completely unenforceable, and get it repealed.
I didn't want to bring this up before the law passed, but couldn't you just create a trust for a gun, call it the "Colt AR-15 assault gun Trust" and add someone's name to the trust for a fee?
