No, it really IS a Union issue. (Specifically a Public Employee Union issue.) My building trades Union is perfectly OK with random drug testing of its membership. It has been for years, and is one of the marketing tools used to make us as workers more attractive to potential customers. The public employee unions have NO competition, and as such can overpay, overbenefit and overcoddle their workers without fear of loss of business or profit, because its all on the taxpayers' dime anyway.

At the heart of this is the fact that drug testing is lame. It doesn't do anything, but make some labs a bunch of money.

The poor bas-tard who smoked some pot at a party over the weekend should not lose his job over a substance that has long since lost its ability to affect his job performance. DAYS later and you still test positive, but have no effects at all.

Its more of a way to pass social judgment than anything else.

I don't think the cops should have to do it. I don't think anyone should do it. And for you old renecks, give it a rest...there is NO REASON pot should be illegal.

I'm all for the legalization of Marijuana but I'm also in favor of an employers right to not employ drug users. Drug users have a choice to not use drugs, an employer should also have the choice to not employ a drug using employee.

Yes marijuana tests positive days after it's mind altering effects have subsided but it's really not an issue that an employer should have to deal with as the effects are know to the average stoner, the onus is on the drug user to pass a drug test not the employer.

That argument is based on the assumption that someone who smokes pot is AUTOMATICALLY a bad employee. Its discrimination. Yeah, I know, its illegal.

I think employers would be better served if there was a STUPID test. As am employer, I have wasted THOUSANDS of dollars on people that are dumber than rocks. I'd take a bright pot smoker any day.

The only drugs that should matter on UA are meth and opiates.

Question to you if there is a drug policy and the person is caught dirty who's fault is it? Who is responsible for their predicament?

Well where I work we are responsible to inform management if we are on legitimate prescription narcotics and they will assess and accommodate it in a case by case basis.

I wasn't going to, but here goes.....alcohol is a bigger problem than keeping someone who smokes pot from working at your establishment.

We could go round and round, but my point is, drug testing, as implemented by most employers, is faulty and unfair. Its not about who is responsible at all. It's about bringing drug testing into the 21st century, and quit discriminating against people who smoke a little pot.

That's just it though, if a business declares that you can't wear a red shirt to work then you as an employee are obliged to follow that rule or suffer the consequences. BTW my job does have a dress code, you can't just wear an AC/DC shirt and feel your non existent rights are violated when you get sent home! ;)

I disagree, it is totally fair, you as the employee work for the business, he doesn't work for you, he takes the risk as a business owner so he dictates the terms of employment not you, you in turn can chose to work there under his conditions or move along, socialism does not work in the business world.

You clearly don't understand the concept of discrimination.

You need to understand that not all of your constitutional rights are extended onto private property or private enterprise.

For the record, I do not smoke pot, and I am 55 years old. My mind is just not closed like some people my age or older.

Trism, you miss the point. You are correct, employers can set the rules. The point is that drug testing as it is today, is a faulty way of screening out druggies.

strive to be better and not worst my friend or you are part of the problem... next thing you are going to tell me is that unemployment for more that 2 years is cool and socialized everything for everybody.. bubblegum that.... laws are laws are laws..
