Oregon campgrounds / parks and guns...

Hey gang. My wife and I are going to emigrant springs (NE OR) and a few nearby parks/forests/hiking places and I'd like to carry my m&p 9mm for general defense. I have a CHL. I'm not a licensed hunter... nor will I be hunting. Can I carry concealed/loaded? If not, open carry/loaded?

An unloaded gun is a club, IMO, and a piss poor one at that... So carrying open/concealed unloaded seems like a waste of time. How do I carry loaded and stay within the law / OAR?

I assume from your statement that your CHL is an Oregon CHL, or is it only WA?

I have both... and an armed DPSST certification if it helps.

Since you hold an Oregon CHL, you are allowed to open carry or conceal carry in all State and Federal Parks in Oregon. Howerver, be advised that you are not allowed in Federal Buildings on Federal land.

Oregon is a preemptive state, so any local laws are trumped by your CHL. Please see Oregon Leg. 166.170-173

Awesome. The place I am staying is on the Oregon state parks web site, but it's called a "state heritage area" does that make any difference?

Emigrant Springs is nice, but it is right off of Interstate 84.

It's my first trip to NE OR as a civilian so being right next to a main road is kind of a plus. We are going to do some driving around the area and will hopefully discover some cool places to hike / camp in the future.

Good to know I can pack heat out there.

That certainly won't hurt if there is any Leo interaction. I'd like to open carry while hiking... just easier / less sweaty that way. I'm gonna need an open carry holster though. Time to do some shopping...

One thing to be mindful of is Indian Reservations. Like Washington, you are not covered with your CHL.

That would be Confederated Tribes of Umatilla. They offer a concealed weapon* permit to Oregon residents for $25.

For reference, I believe the Tribe can only expel a non-Indian OR CHL holder for carrying a concealed firearm. Criminal penalties are only effective for those subject to tribal law. However, for non-CHL holders, a cross-deputized Tribal officer could arrest and refer you to OSP for violating ORS 166.250.

*Curiously, this permit claims to allow concealed carry of any weapon, not merely firearms. Not sure if that is legally effective for non-Indians. Possibly a Tribal officer might still arrest and ask OSP to charge you for violating ORS 166.240, even with their local permit.

I'm not an OR resident so I don't think they'd take my $25. I'll just avoid their land. Their loss, they could prolly use some tourist dollars!

Hmmmm... It appears that i-84 runs right through the middle of the reservation. So...how should I transport my gun through that area? My hatchback has no trunk. Locking case OK?

You have free passage on the Federal Freeway, and maybe the State Hiway that connects to it. You can carry on your person or in the vehicle as long as you are traveling through. If you stop at the big gas station/truck mart you should lock it up. The pumps are self serve, but don't carry if you have to go inside to pay.

Absolutely no firearms on Casino property. I guess they don't want you staying in the attached hotel either.
