IMO, they don't want it to go to the Federal Supreme Court and are trying to give the legislature time to come up with a work around.
You could argue the other way too. This buys time for the other California cases to work through the ninth such as the magazine ban that is due out soon which will be appealed up. Once the 9th is forced to come down on the mag ban, this part of the law for sure will go. The permitting piece sigh ...
 
Guys, anybody who says the supreme court is doing this or that or saying unconstitutional or waiting for legislature please read the actual ruling in #45 above. The OR supreme court is simply saying it would be inappropriate for them to weigh in at this early stage. That is all. They are not saying anything whatsoever for or against this case.

SCOTUS does this also. The facts have to come out in a lower court and a ruling. Then it can be appealed to the supreme court where it will have all the info for them to look at it.

This ruling only means they will not get involved at this early stage. That is all it says.
