New York arresting gun owners traveling through airport

    I will not only avoid New York, I will not patronize any business that resides there. What do they make that is worth a crap in New York anyway?

    This needs to be trotted out every few months. Keep in mind that New Jersey and New York operate the public transportation system together. So if you fly in to Newark, no problem When you leave, and then bring your pistol, just like you would in the rest of the civilized USA, you find yourself arrested. You are in NJ but the arrest is on the NYC laws.

    Be certain you know the law where you are traveling.

    Anyone want to drive to Alaska?

    As I understand it, FOPA covers traveling through states with strict gun control laws not to states with strict gun control laws.

    The example is if you are driving from Virginia to Vermont and you pass through NY and NJ, you have no problem if the firearm is unloaded and stored away from the driver. The driver is allowed to make stops for food and gas. That is different than if you are going to NY. If you're going to a place where having the firearm does not comply with local law, that's when you can get into trouble.

    I'm not up on NY gun laws but it seems there is a requirement for a person to have a permit just to possess a firearm. It's not hard to see how an out of state individual would not have that permit and then be in violation of the law by mere possession.

    They have interpreted it that you are not just passing through if you drive to the airport. (Not saying it is right, just that's where they hang you.) If you drive through the state, then the FOPA safe passage rule would apply. If you stop for anything but gas, though, you are out of luck.

    In NY State, it is not legal for a non-resident to possess a handgun except in very limited circumstances (competition, primarily). Then you get the city's heap of laws on top of that.

    I understand that but I thought one of the cases (not in this thread) a while back had to do with a person that was flying though. Person never left the airport and it was in his checked baggage.

    There are several cases involving NY and NJ airports. You might be thinking of the case with Revell. The guy was from Utah and going to Allentown, PA. He missed his connecting flight in Newark, NJ. The airline was willing to bus him to PA but his luggage had not made the bus so he opted to collect his bags and stay in a nearby hotel. When he tried to check back in the following morning that's when he got in trouble.

    Just another place on my "never visit" list. New York is a joke. It is way over-rated, over-populated and run by some of the most arrogant and anti-freedom politicians in the country. The people voting these folks in in NY must be absolutely brain dead. They clearly have no understanding, nor desire to understand, why and how this country was founded.

    What I don't get is how someone hasn't brought a federal case against the state for violation of second amendment rights? It happened in DC, why not NY? SCOTUS upheld it in DC, I would think the same would be true in NY.

    I have in-laws that are flying over from Australia and they want us to go to NYC with them... My Aussie wife can do what she wants, but there isn't pigs flying outside, and I've not heard Satan is wearing an arctic parka in hell just yet... So I will NOT be going along.

    Just a little defensive positioning - there is NYC and then there is NY.
    Upstate, would probably vote to have Russia take the NYC area.

    Not to say NY State can't do stupid, very stupid, things.

    But, do know that in other than the city, the hunting and gun culture are alive and well. The issue is that the City gets it's way on all state wide issues due to the population center.
    And, many consider Albany to be a NYC borough, or puppet.

    Yes I believe they're f**ked. And it's all because of NYC.
    But until some of you walk in their shoes, you should keep your ignorant remarks to yourselves. You talk like you know it all. You don't! You have no idea what it's like to live in NYC. Those people have been brain washed since the early 1900s. In a city with a population of 8 million plus people, there's very little that can be done without waiting years to be heard. And the NRA, and other gun groups are no help, other then offering lip service.
    There was a time when NYC and the rest of N.Y. seemed like like two different states.
    Because of the 2A freedoms we have here, you're so arrogant to criticize others.
    Instead of bad mouthing it's people maybe try to support them.

    NYC and NY are the way they are because they keep electing the likes of Chucky Schumer, Charlie Rangle, fatty Adler, and that schlub sitting in the governor's office, and that jerk Bloomberg... Is THAT enough "arrogant ignorance" for ya?

    If NYC is so great, STFU and move back there.

    The likes of Rangle and Schumer and the others are elected because of the brain washed people that make up the majority of the population. There's no need to be bad mouthing the rest of the state because you have it so good here.
    Unfortunately they don't have a 2A in their state constitution, like we do. That's about all that's saving us from being like them.
    Read every thing I wrote instead on focusing on your own hurt feelings.

    I was fortunate enough to be able to get out of N.Y. most aren't because of work and families. I've been here since 1977 and as much as they try, things don't change because of N.Y.C. politics. And no I don't thing they can vote out the democratic mentality.
    Would I ever go back ? Never !

    I do apologize to all for my strong wording, but that is my home state and doesn't deserve the strong criticism posted here. Especially with the way things are going there.
    I believe what's gonna happen in CT. will decide on how N.Y. will respond.

    First, why would I take up "the cause" of comments you made towards others? The others are adults and can push back if they so choose.

    Second, I don't get "hurt feelings" over bloviating rants from a pugnacious "east coast" minded dip-dunk. If anything, I find you mildly amusing and you remind me of all those football fans who actually behave like they're on the team (of their choice) and act like the final scores actually make a difference in the world... Oh, please.

    Third, you just made the point for all the reasons on the disparaging remarks about NY, and NYC (in particular) with your admission of all the "brainwashed majority" that keeps re-electing the COMMUNIST TRAITORS that manage to affect the rest of the country. Yes, we know upstate NY is a "different planet" from NYC, but Albany is occupied by Mario Cuomo, ATM.

    Fourth, words mean things. Oregon doesn't have a 2A as you mentioned. It has Artcle-1, Section-27. Speak precisely instead of when your temper is OBVIOUSLY influencing what you post. Who really sounds like a kid, and YOU call ME an idiot?
