You don't know that. All we know is that he was shot somewhere around the shoulder.
The USCCA video said he was shot in the lower left chest, not shoulder. That's even evident just from watching any video of the shooting. Looked like a gut shot, to be sure.
 
It doesn't matter if any of us watching the video didn't see an eminent threat, it matters if HE perceived there to be in eminent threat.

Luckily the jury leaned in his favor. Next person to pull this stunt may not be as lucky.

You are not wrong. I'm just saying from what I saw, I do not believe I would have pulled the trigger had I been faced with the same. The Fox spray would have been flying though!

And if it aggressed after that, that's basically him choosing to get shot.

5. Don't stop to entertain the prank
6. Don't get involved or swat at phone
7. Watch hands and walk away

If you react they get exactly what they want. Have your head on a swivel and move with a purpose.

Obviously he was so timid his gun was his only solution to conflict. Pathetic situational awareness. Pathetic response. Pathetic planning. Pathetic shooting. Pathetic all the way around.

Atleast I got a laugh out of the video.

Not exactly, it is based on the doctrine of the reasonable person. If your perception is not reasonable, your actions are not reasonable.

I think what is getting lost here is the "armed citizen" in this encounter does not make the rest of us look very good. IMHO we need to have the intellectual honesty to say this guy did not act reasonably.

I also think we are all sick and tired of jerks like the guy who started all of this. Sometimes it's hard to separate the two...I get it. Hence, jury nullification.
 
But who am I kidding, after a pepper spray shot, I'm either kicking in their knee or running. It depends on if I have family to protect.

I run the belt line. Fox spray is horizontally on belt at 11 with opening to right side, accessed by either hand. Spare mag is at 1, also horizontal, with opening to left side. Accessed by either hand but intended to be off hand while dominant hand has pistol in it.

Gun is typically at about 3:30 to 4:00 on dominant side.

But, I'm not physically that interesting of a target, I bet had the intended victim been the same size as the bigger aggressor they never would have picked him.

There are plenty of things we as individuals can do to come across as a "hard target."

Stand up straight
Proper posture
Eye contact
Head on swivel
Don't be a fat slob
Don't look at your phone/ground
Clean cut/taken care of
Proper clothing/footwear
Physically fit
Empty hands
Space
Know routes of escap
Don't put your back to doors
"Size up" everyone who comes into the room/location

I suggest that anyone who carry's a gun and takes it seriously read "Left of bang."

I think what the verdict showed more than anything was that the people on the jury are tired of these idiots harassing/abusing/assaulting people and calling it a "prank."

Pranks are supposed to be funny, but harmless. These people are just being dick heads and the morons that find them funny have the collective intelligence of moss, and dumb moss at that!
 
Today perceived eminent deadly threat , is not determined by what you think is a deadly threat.
Its what a liberal Jury will think was one.
Because doesn't matter if your life is in Danger, you can't just think, now days you must prove it.

Was it a valid shoot? In my eyes. No. I have had many people walk up on me and what seemed a threat.
Was actually them being stupid and getting in my space.

I know you have zero time to think. And you have the right to stand your ground.
But again, its not what you think, its what a anti-gun liberal will view it in court as.
Or worse a Lib-Judge.

We train here, to avoid pulling a firearm at all cost. We have had to learn to work on when to act.
It sucks, because as we say with Kyle, being chased by many armed ppl may not be enough.

In hind site, he should have sought security, or called 911 as walking away. Over go to gun first.
But I was not there. So what do I know.
