Legislative Update from Olympia 11 March 2011

CHAMBER CUT-OFF PASSES

SBs 5112 AND 5634 DIE AWAITING SENATE VOTE

PUBLIC HEARINGS CONDUCTED ON HBs 1016 and 1455

HB 1016 PASSES SENATE JUDICIARY COMMITTEE

PUBLIC HEARING SCHEDULED FOR HB 1923

At 5 p.m. last Monday evening (incorrectly reported last week as Thursday) all bills that had not passed out of their original chamber (House or Senate) died for the remainder of the session. Senate Bills 5112 (suppressors) and 5634 (CPL background checks) were in the queue awaiting a Senate vote when the clock struck 5. There doesn't appear to be any malicious intent there -- more than 100 other bills suffered a similar fate.

At this point three gun-related bills remain in play: HB 1016 (suppressors), HB 1455 (restoration of firearm rights) and HB 1923 (CPL qualification). HBs 1016 and 1455 were heard in public testimony on 9 March. HB 1016 (which has duplicate language to SB 5112, unanimously passed by the committee earlier in the session) passed out of Senate Judiciary and is now in Senate Rules awaiting a vote of the full Senate. HB 1455 is still waiting for a committee vote.

A public hearing is scheduled for HB 1923 in Senate Judiciary on Friday, March 18. The hearing will take place in the Senate Judiciary Committee in Senate Hearing Room "1" in the John A. Cherberg Senate Office Building.

Looks like they want an additional NICS check along with whatever they are doing now? At least that's what I see.

Summary of Substitute Bill:
A law enforcement agency must deny an application for a concealed pistol license if the
applicant is prohibited from possessing a firearm under federal law. Law enforcement
agencies must conduct a NICS background check of the applicant to determine the
applicant's eligibility for a concealed pistol license.
An applicant for a concealed pistol license who is not a United States citizen must provide
the following additional information on the application: country of citizenship; United States
issued alien number or admission number; and claimed basis for being exempt from federal
restrictions on firearms possession by aliens.
