2022 WA Legislative Session - Week 5 Summary and Week 6 Help Needed

Most important info first: ESSB 5078, the mag ban bill, was passed out of the Senate and will now be heard in the House. HB 1705, banning "ghost guns", was passed out of the House and will now be heard in the Senate. We need overwhelming pressure on legislators to stop these. Welcome to another in a series of threads discussing the 2A-relevant bills being discussed during this year's Washington state legislative session, which runs from 1/10 to 3/10. In these threads we will be providing an overview of the bills and how to take actions against the bad ones.

Week 5 Summary

As you may be aware, ESSB 5078, the magazine ban bill, was passed out of the Senate. I have seen so much incorrect information about this bill over the last couple days that I want to point to this excellent summary and make a few comments. The bill as passed by the Senate bans the purchase, importation, and transfer of magazines that contain more than ten (not seventeen, per an earlier version of the bill) rounds of ammunition. The bill does not require any photographic evidence of your possession of the magazines, as that clause was removed from the bill with Liias's amendment.

Also important is that ESSB 5078 is the bill to focus on, not HB 1164. The legislative process works such that ESSB 5078 heads to the House. The House does not consider HB 1164 as the next step. Do not bother commenting, testifying, or writing your reps regarding HB 1164.

It is worth noting that this bill is an extreme measure that would make Washington one of the most restrictive states in the union.
For comparison, Illinois and Hawaii, two of the states with harsh gun laws, do not have magazine limits to the extent that ESSB 5078 would enact. (Illinois does not have state laws limiting magazine capacity. Hawaii does not limit magazine capacity on long guns.)

In the house, HB 1705, banning "ghost guns", was passed. This bill now heads to the Senate for consideration.

Other 2A-relevant bills that remain alive are SB 5568, partially repealing state preemption laws, and SB 1630, banning carry of firearms at certain locations. Tuesday, 2/15, is the last day to pass a bill out of their chamber of origin, so these bills may be headed for a floor vote Monday or Tuesday.

Week 6 Help Needed

We need to spread the message far and wide opposing ESSB 5078.
This is an election year for every member of the House, and they need to understand that this bill is widely unpopular, ineffective, actively harmful, and we will campaign against Representatives who support this bill. Every single gun-owner in Washington needs to take action. There are four ways to make your position known, and it will be most impactful to do at least the first three of these:

1. Comment on the bills and have your comments sent to your representatives. Request a response from them too. You can do this using the "comment on this bill" feature on the bill information pages linked above, or you can go directly to this page: Comment on ESSB 5078, Comment on HB 1705.

2. Provide written testimony on the bills and have your comments sent to the relevant committee. You can do this via the Committee Agendas page. Select Civil Rights & Judiciary for the Committee, and 2/16/22 10:00 AM for the meeting. Then select "I would like to provide written testimony" and enter your comments.

3. Have your position noted for the record. You can do this on the same Committee Agendas page as above. Use the same drop down menus and select "I would like my position noted for the legislative record". Note the system defaults to "PRO" so be sure to select "CON".

4. Testify remotely. Again you can do this from the same Committee Agendas page using the same dropdown menus. Remote testimony is done via Zoom. There are time constraints during committee meetings, so you may sign up to testify but not get the opportunity to do so, which is why I advise submitting written testimony as well.

Please share this message far and wide. If we're going to have a shot at defeating these bills, we need overwhelming amounts of calls, voicemails, and pressure on the Representatives, especially those in weak/swing districts. Calls are worth more than emails. In the House, we are focusing on the following Representatives:

Numbers matter and we must keep the pressure on. It unquestionably helps our cause to have overwhelming amounts of testimony opposing these bills. Keep your comments civil, articulate, and brief. For written testimony I would advise keeping it to one paragraph.

Please reach out if you have questions and thank you for stepping up to defend your rights. We have stopped bad legislation in the past few years and with your help, will continue to do so.
 
Mention that the overwhelming majority of police officers plainly say that gun and magazine bans have no effect on violent crime. Suggest they ask street level police themselves, not chiefs or other political appointees who can be fired for having the "wrong" opinion.
