Has it occurred to anyone that if the op did not involve LE and simply gave the firearm back to the female...that technically a violation of the 2015 private party transfer prohibition would have existed ?
Except it's not, in any stretch of the imagination. A change of ownership has to occur... not simple possession/custody.
He had no way to confirm that she was the legal owner and had an active CHL. The LE did.
Which he had no authority or mandate that required him to be verifying anyone's CHL status... other than his own. Someone who feels like they do or should... there's a name given for folks like that. 🤣

If someone is in doubt if it was hers or not, they don't have to confirm it to the point of having to prove it in court to a judge. Only to the point that they reasonably believed she was the owner.

Some simple test would be more than adequate. What make and model is it? Color? Caliber? Mag brand? Ammo type and mfg? Any identifying marks (scratches/blemishes/holster wear/etc)?

Of course, there are some gun owners that might not even be able to answer all that with 100% accuracy, but you only have to have reasonable belief that they are the rightful owner to absolve you of any liability.

A case might be made for someone withholding and denying access to a person's personal property though. Of course, that would be just as rediculous as running a gun owner over the coals for a brain fart. 🤣



On another note... I really liked the auto keys example above. If we're gonna play the 'what if' card to justify extreme measures... how do you know that person is sober, mentally stable or not under the influence of a drug that may make them a danger to themselves or others before giving them their dropped keys back? I know, right!? What if an unlicensed person had found their keys then went out to the parking lot and started playing pedestrian pin-ball? It's inexcusable that a person would not be responsible enough to keep their keys safer, hu! Call the police! Think of the Children!!

There are many gun owners that are actually afraid of firearms, but try and keep reality in perspective. Especially when it involves choices that affect other peoples lives.👍
