All legal Assault guns in California are now registered with the state, and the info can be quickly accessed by anyone in law enforcement. California has a very modern firearms database. An entire state agency, called the Bureau of Firearms, is charged with keeping track of all legal guns in California. So these issues you raise are all non-issues.

Now if your gun is not already registered, then you are automatically in violation of the law, and your gun will be confiscated. It will not matter when you bought the weapon or if you can prove the date of purchase at this point in time, if you failed to registered it within the deadline specified by the law. You will be arrested for illegal possession of an unregistered assault weapon.

To show how insane the state legislature in California is, in 2013, California Governor Jerry Brown vetoed a bill past by the legislature that would have expanded the definition of an Assault Rifle to cover ANY semiautomatic rifle that could accept a detachable magazine. Brown said that it was an extreme measure, and carried the definition of what an Assault rifle is too far, and was only serving to ban semiauto guns designed for hunting.

There are actually three different classifications of Assault Weapons in California law, as twice the legislature has past new legislation broadening the definition of what an Assault Weapon is. These Assault Weapons bans were past in 1991, 1999, and 2000. So Californian gun owners have actually been through 3 bans.

If the 2013 Bill had been signed into law, even these Brownings show below would have been considered to be Assault Weapons. That is how far some Democrats are willing to go.
