I used my gun and fired 3 warning shot in Weeding, CA

    This story happen few months ago, and I was till paranoid to posted here due to all the legal issue. I just wanted to see any further law sue involve before I make it go into public. I posted this for senerio discusion

    I was with my parents at the rest area in Weeding, CA. My dad got hungry so we stand behind the back of our car eating bbq chichens and stretching our legs around 2am. We are heading back to grants pass, so it was still like 2 hours away from our trip. As we were eating, there is a white dodge 4 truck pulled up 5 or 6 parking spot from us. There was around 2 guys and 1 girl run to the restroom passing us, and there still couple more people standing outside their pickup truck doing what so ever I really dont care because it was dark. Suddenly there is a guy come back from the restroom walk by my car and he said something I am pretty sure it send that message to me but I didn't want to think he did so I ignored it, I heard he said "studip MTFker", I ingored it, I continue eating my bbq. one hand holding chicken leg and one hand hold the bones left over bones. The guy walked by me suddently walk back to us and in a drunk/high tone asked if I was giving him a dirty look. I respond no sir and he walk toward me slowly because he drunk or high. At that time I knew trouble coming. I dropped the chicken and the bones on the ground reach in open my suit case and pulled reached for bot of my hand gun in the suite case. Remember this is a trip back from cali so I have to put my guns and the mags in the back of the car seperate. He wasn't standing closed to me but he then walked behind me. I grabbed my magazines and pushed it in my guns. I always have two with me, while I was doing that I told my dad in my own language that this guy is looking for trouble and we get out of here. Each of my hand hold one gun, the right hand hadGlock 21 sf and the left is 380 small that I alway keep in my car as a car/backup gun. My dad closed the trunk of my car, I kept my firearm so closed to my body that I dont think the guy see it. I stand at the driver passenger side to wait for my dad completely got in and closed the door before I get in mine. As I was sitting down and about to closed door the guy walked up to my driver side. I placed my backup gun in the driver side door, by the way my glock still in my concealed carry holster and it's on my right hand. The guy walked up to me and wont let me go, my mind was busy thinking how I am going to handle is sistuation then I heard him said something about "breaking my window or winshield" then I had a thought that if I dont make the big scene here this guy will keep on following me even if I get on the free way he may chase me down and hurt me more then here in the rest area. So I look around and see all the semi truck parked on the other side of the rest area, I dont think they can see or hear what is going on. I need to do something here safe at this rest area before I move on so I decide to yell out for help. I withdraw my gun from the holster and holster and stand up tell the guy back back up in a really loud voice but I dont know he hear me because he is messup. I pointed my gun in the air and fire a warning shot because his distance is getting too closed to me. He felt on the ground, and flip around crawled on his knee and ran over to his buddy calling for help. I picked up my cell phone dialed 911 and letting them know that I did a shot warning. While I was on the phone with the dispatch... two of his friends try to come up to me. Now I was in front of my car because I have to give the dispatch the location, I didn't know it was Weeding Rest Area so I have to go in front of my car to look at the name of the place. Two of his friend acted like they about to kill me with their bare hand, I look to see if they both have any weapon on their hand. If they have a knife or baseball bat or anything in their hand then I have to point my gun at both of them and empty my clip, luckly for me both of them have no weapon on hand. There was couple girl that hold them back told them to stop coming toward me "thanks to the girls" at that time I know if they both get closed to me then I have to shoot them down. While the girls are restling with the guys to hold them back I also describe what is the sistuation at that moment to the disbatch, I even yelled at them as many time as stay back, back up... with my really angry voice. I saw one guy got out of one girl hand and walked toward me so I shot a second warning in the air. It kind of pause him a little and the girl come up hold him again. The other guy got out of the girl hand and I did another shot on the air hold him back. This was going on for a very long time. I wasn't sure how long but it seem like very very very long time for the cops to arrive. Finally they know that I was seriously about they come foward me so their friends from the truck came over and pulled those two guys back to the truck. I guess they want to go away but the two rambos in want to get into their trucks so they wrestling around their truck. I was still on the phone with the dispatch and keep my eyes on them see if any weapon coming out. I told my parents to lay flat on the seat with head down and I hide behind my front car only the head stick up to see what is going on over there. The whole time I have no gun pointed at anyone, my guns point to the ground and on the air for the warning shot.

    State police arrive first, I see them pulled in the rest area, I told the dispatch and the distpatch told me to put my weapon away. I put my weapon in my right pock, and raise both of my hand above the shoulder. State police came out with shotguns in the hand two cars at the time, one officer behind those guys truck and one walked slowly to me with shotgun in the hand. I told him where the fire arm is and still have my hand on the air. He reached in and I told him it's loaded and one in the chamber. There were 5 or 6 more officers cars arrived. I have to reapeat the story over and over for more then 4 officers. They hold me there talking for over an hour and half.

    Anyway cut this story short, they took both of my firearms and all my IDs and my parents. Ran background check, check to see if the firearm was legal then give me a lecture about what go up must come down. I may have hit an innocent when it come down. I told him I was too nervous and scare didn't know what to do. I think their is a commandor come and talk to me and he said what i did was good because there is noone hurt and I told him that I really didn't want to hurt anyone. I just want to have safetrip back to Oregon. They let me go and of course a officer place my both of my firearms back to where it belong in my suit case unloaded and the mags on the other side of my trunk.

    WOW. That's a story. Good for you to protect yourself. Sorry I misread it I didnt know it was you benny. That's a pretty intense situation. Especially with your parents.

    My question is do you have a CC in california? if cali is so strick on gun control then just wondering what your legal outcome was if you didnt have a cali CC. At any rate, sounds like you made the best out of a crappy situation.

    what happend to the guys when the cops came? Nice job. But I do agree what goes up must come down.

    Was this in Weed or Redding....I don't know of any place called Weeding, Ca.
    Either way, you did what you did and lived to tell about it. This part of extreme Northern California is full of rednecks..there's also a very high methamphetamine addiction rate...so basically, you're never certain of what kind of personality you're dealing with.
    The cops are right about shooting into the air of course- but as long as you kept your story straight, the shear number of people you were up against could easily be used by you to explain that you had a reasonable fear that they were about to harm you or your family...that could help justify the extent of your fear and response.
    Here's a rule of thumb I follow when I'm traveling...don't stop at any rest stops at night. The bigger truck stops are safer in my opinion. Unfortunately there aren't many between Redding and Ashland on Hwy 5.
    Not that it matters, but where are you from originally?

    I don't believe you need a CC to defend yourself, even in California, in a life-death situation.

    Sounds like you did everything legal. Sounds like you were left no choice but to fire warning shots. I would be worried though of those rounds hitting innocent bystanders. I always wondered what the best place would be to fire warning shot. As far as getting Cali CC, thats impossible if you live in Oregon. Its hard enough if you live in Cali. LOL

    By the way were you in Weeding or Weed? I never heard of a Weeding.

    Oh Yeah, Thank God you and your family are alive and safe. I commend you for your bravery.

    Hence, another reason not to travel to Killifornia.

    Nope, I dont have CA cc. That's the reason why I left my hand gun in my suite case and the magazines on the the side. I left them all at the same time everytime so I know where to get it. Well the legal outcome is that the let those guys go and two police cars escort those guy to their home in Yereka. As for me a state police escorted me all the way pass Yreka that is what they told me and I saw them drove passed me on the way I drove back to OR.

    I be honest I really dont know it is because of my race or because they are drunk/high/showup to their girls in their truck or what. Anyone there around that time would get pick on by them too I think.

    I was worry for my parents more, my dad is in 68 and my mom is 63 years old. Anything happen to me in front of them will put them into stress and they may not be healthy :)

    Yeah it was on Weed Rest stop area, between Redding and Yreka. Yeah myself and my family learned lession not to stop at the rest area at night. We stop at the gas station now. I am Vietnamese.

    Yeah you are probably correct they were playing hard guys to impress the ladies! Nothing turns the chicks on more than laying on the ground in a pool of your own blood! :p

    I was thinking, if I had my parents with me my guard would be 3 times higher. I would think people at reststops are tired & maybe a little irritable.....I will stay away after hearing this.

    I was surprise because none of the truck driver ever come out to witness anything. I guess my 45 wasn't loud enought to wake them up.

    That night I was being questions over and over again where was my gun, and where was the magazine located, and the story over and over again. I told them exactly the same what happened nothing to hide. They could of listen the record with dispatch because I was on the phone the whole time with the dispatch. I am glad I am safe now, I am glad that my parents now do believe in guns protect good citizens :) After this incident I am more aware of the surrounding and instead of spending my money on other luxury I am spending it in self defense classes. AFO here I come :)

    Good for you.:thumbup: You would think a .45 wouldn't need to fire 3 shots. They should have took off running after the first shot.

    I like to say "Thank You!" to the girls that hold the guys back without them I dont know what was the outcome will be. I am glad that they didn't have any weapon on their hand, and my distance to them are still in my comfort zone. BTW those guy are a lot bigger then I am he he he

    well done. Benny. You did the best under the crazy situation. Yes, California makes it real tough on gun ownership. Lots of folks get beat up and worse because that stupid populationn holds a beat up guy lying in a pool of his blood in a roadside rest parking lot is a higher moral value than a man carrying a handgun on his person.

    what amazes me is that these cops let the creeps go..... sounds like they were drunk or on drugs.. did they do any testing? How about public nuisance charges? Maybe disturbing the peace? a low-grade assault charge? ANy alcohol or drug at all shoudl have led to more serious charges.. drunk driving, in care of a vehicle whilst drunk, drunk and disorderly..... this sort of thing makes me mad.... the cops had a live situation with a bunch of thugs getting out of control and threatening imminent bodily harm to innocents... and let it all go by?? I'd be thinking about a civil lawsuit for endangerment, assault, mental anguish, hey, play the hate-crimes/racism card. SOMETHING to make these creeps think again before carrying on like a bunch of schoolyard bullies. Good job you were armed..... and had observed California's fascist gun laws to the letter.

    Oh, and I have to agree with shooting into the air... dangerous. Although there in Weed, the chances of hitting anything significant is almost nil..... but still, good habit to get into.. find somewhere else where the shot's final destination is known. That is one of the essential parts of gun control.
