Washington I-1639: Could the new Jan 1, 2019 law lack a missing definition?

I just saw a news article this evening. Could it be true?


New Washington gun laws spark defiance

Teasdale and her staff at Lynnwood Gun are continuing to sell semi-automatic rifles to customers under the age of 21.

"It's a feel-good law, that's what it is," Teasdale said about Initiative 1639.

Teasdale said she has consulted with lawyers about the language of the law. She said she has also reached out to Attorney General Bob Ferguson's office, but hasn't heard back.

"The term semi-automatic assault rifle doesn't exist for another six months," she said. "How are they telling us we can't sell something that doesn't exist?"

Teasdale said she sells a number of "long guns," including AR-15s.

I haven't read the law but this is one of the problems with many initiatives; not written by lawmakers and therefore there are often problems with it from a legal perspective.

Yes, it's technically correct to say that there will be no statutory definition of "semi-automatic assault rifle" until July 1, 2019. But, that doesn't mean that section thirteen of the initiative (which prohibits sale of an AR to anyone under twenty-one) is null and void. When terms are undefined by statute, courts generally fill in the common dictionary meaning.

So, if the dealer receives more publicity and business because of this stunt, great. But, she is also playing with fire.

Some Lawsuits have been filed now in the USA where 18 yr olds have been denied their right to purchase a long gun, which Federal law allows since 1968. Prior to that anybody any age could buy a gun and ammo and oddly enough , we didn't have mass shootings by depressed teens from Democrat families !
We were taught to never point a gun at anyone , and that you could not recall a bullet once it was fired.

So here's our take. The bantering about of the term "assault weapon" is irrelevant, its a name. However, now it is codified under the RCW, 1639 defined the term pretty cleanly and the law was passed. The terminology is all there and its part of the RCW under the law. I'm not saying its correct or proper, but the crafty bastards got it done and now WE are challenging it in Federal Court.

Selling a semi auto rifle to a sub 21'er could be enforced by the state. The state will pull the state dealer license to start, then who knows what else they'll do. We're preparing for the worst here.
