I believe the concern with a predator that size is that once they kill and eat a human, they stop being afraid of them and will likely make it a habit to supliment cats and dogs with people...

Still kinda sad to kill the animal for the guys dumb thought process that told him to hide there.

If a person knows you are home and they still choose to break in, they probably need to get shot. If they are that careless with their own life they will be more careless with another's.
From a philosophical standpoint (with my 9th grade education) it is not the severity of punishment that is a deterrent, but the certainty of it. Knowing that to be true, allowing people to continue to invade, and/or threaten people in society is itself immoral. This is however assuming you are in an area that is crime ridden with little police help other than taking down info and telling you to basically write off your property.
You do not know what the person is capable of nor what they will escalate to in the future, and letting them go in that instance is passing the problem to someone else to fix, which with our legal system, won't.
