GHEI: ATF's latest gun grab - Washington Times

Agency reduces due process for seizing firearms.

The Obama administration is making it easier for bureaucrats to take away guns without offering the accused any realistic due process. In a final rule published last week, the Justice Department granted the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) authority to “seize and administratively forfeit property involved in controlled-substance abuses.” That means government can grab firearms and other property from someone who has never been convicted or even charged with any crime.

The disarming of America.

You don’t even have to be charged with controlled substance abuse. The ATF (or TSA) just has to think there might be substance abuse or investigates controlled substance abuse. It's upside down now. The burden is on you to prove your innocence and get the property back.

I must be psychic today, I already know what the defenders are going to post.

What might that be? That it's funny that Holder seems to want to do everything possible to hurt his ability to stay employed? That's not really psychic, that's pretty obvious.

So the question is whether or not the NRA thinks that it's worth pushing to Romney's group to raise a stink about his conduct. It would be the ideal opportunity to bring this along with attention back to FNF to see if there's enough of a churn and concern that Holder voluntarily resigns. He won't, but it's nice to think about.

Let's see alcohol and tobacco are both controlled substances, widely used (people forget that they are controlled substances). So the police see you have a gun rack in the back of your truck and notice you lighting up after buying a case of beer. They follow you to your residence and give the address to the ATF. The ATF knocks on your door and says we notice you bought a case of beer and a pack of smokes, we think you are abusing these controlled substances. We will be confiscating your firearms until further notice. Not saying it is going to happen, but with what is being presented, it could.

Law enforcement agencies love civil forfeiture because it's extremely lucrative. The Department of Justice's Assets Forfeiture Fund had $2.8 billion in booty in 2011, according to a January audit. Seizing guns from purported criminals is nothing new; Justice destroyed or kept 11,355 guns last year, returning just 396 to innocent owners.

:huh::huh:

This was common in Europe and was one of the reasons we fought a revolutionary war and a Bill of Rights was penned.. looks like it's time for part two

the ISSUE IS WITH CIVIL FORFEITURES, WHICH HAS BEEN A TRAVESTY SINCE THE 80S. glad YOU GUYS FINALLY CLUED INTO IT.

I was going to say, this isn't new at all. They started doing this in the '80s with a 'Guilt by Association' type of model. This is how a lot of the DEA got its equipment and funding. They just kept everything they seized and used it against the drug dealers. Most people said 'eh' I'm not a drug dealer, so it wont' happen to me.

Civil rights are civil rights, lose one you lose them all!

U.S. Constitution - Amendment 4

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The 2nd half of the 4th amendment, (like the 2nd Amendment) helps define the first half.. NO searches without the prerequisites listed are Constitutional. None

At the Federal level, it will not only take the people to get back the White House into more reasonable hands, we will need to hold on to it for at least 8 to 16 years, and we will need to have strong lobbying against the "more government is good crowd", and we will need to be successful against such people.
Furthermore, we will need to toughen up the GOP, and get more Constitutional people elected into office.
I fear of we do not then the 1st. and 2A will be nearly a thing of the past.

I agree and disagree with you Gunfixx.

On the long fight to take back our country and using the system to do exactly what they have been doing. I agree. That makes sense. I believe the system is broken, but fixing it from within can happen. It takes long term vision, focus, drive and determination. It has been pointed out before, but the President of the United States is paid $400,000 a year. Yet it takes millions and millions of dollars to get into office. Think about that for a bit. It will make your head hurt. Why would you spend millions to only get paid $400K? We need campaign reform in a HUGE way. Something to off-set this type of buying of our political system. And Education, so people are smart enough to see through the crap that both 'sides' spew.

As for toughen up the GOP? Those fat cats are no better than the DEMs. Outside of elections, both sides play to the middle. Both sides are in the pockets of which ever corp or group pays them the money. George Washington warned us about a party system, and this is why. Look at people's voting records without party affiliation and I bet you won't be able to figure out who is who.

Don't believe me, ask yourself about Medicare. Yes, it is a National Health Care system for retired/elderly people. Everyone says National Health Care is Socialism. Yet don't touch Medicare. WTF? I agree we have to take care of the elderly, great. So why don't the families do it. Or perhaps people plan for it in the future. Or perhaps that be a decision for companies who want to attract better employees. That would be capitalism at work. And that is just one example of the two faced for the GOP.

Don't get me started on the DEMs. They are supposed to be protection civil liberties and rights. Yet they love to take away land, still haven't closed Guantanamo Bay, and kept the hellish Patriot Act in place. Sure Bush started a lot of this crap, but if they were really freedom loving, "Make Peace, not War" we wouldn't STILL be in two wars and still have Guantanamo Bay as a private non-US prison.

Both parties blow goats. While I agree with some of the Tea Party, they had the right idea. Raise our own money, create a new party. Get change done. They just don't have the patients to do it for the long haul. And I they have turned out to be basically an arm of the GOP. On the DEM side of the fence, you have the Green party, basically not having the focus to keep going.

Actually, I take it all back. I have a solution, and it comes from the old movie "Brewster's Million." "None of the Above." That is what we need on very ballot. If neither side gets a majority, then both candidates are tossed out and bared from running for any office for 1 year. New candidates have have 1 month to run. Sure, it would create chaos for a while. But lets face it, a little chaos would be welcome compared to the 'normal' conditions.

OK, this is my rant for the day. But like you, it all makes me sick!

IMO it's too late to use the system. Very soon the alien invasion (legal and illegal) will overwhelm our ability to vote the traitors out. It's already happened in California. Most of the incomers have no idea what the BORs is about, and these also do not share our vision
