This has been discussed on other forums like AR15 Dot Com and the consensuses is that anything that is not 90* is good to go, even if it is 89.9*

If they provide a legit approval ATF letter with it Id get one.
They have a point, what does "vertical" measure at. wonder if they'll (ATF) state that it has to have a web to act as a "rest" in order to not be a secondary "grip".

Not sure, its been called that (the term web or webbing) on other forums in descritpion of what it does: blocks the web of the hand from seating in a grip position therefore turning it into a hand rest or "angled fore-grip" rather than a vertical grip. Sure, there could be another name, Im just parroting what Ive read description wise.
