A buddy of mine got an infraction offense against him based on a small amount of weed at a traffic stop in SoCal. It was under two years ago. When he fills out his CHL app it asks for any past infraction.

I've told him he needs to be honest because it will show up.

My question is assuming he's homest about it, will he be denied a CHL for this?

If this is his only conviction for a controlled substance, One and only, no DUI also, He needs to wait 4 years before he applies. Any conviction of a misdemeanor in the previous four years will get him rejected.

that's actually two problems, then imo.

one, that there was a misdemeanor (infraction?) in the past four years, and

two, that this fellow had appeared in court on drug charges.

my recommendation is to kill both birds with one stone, and get the conviction expunged, and to apply after the expungement.
