They can. They have (as pointed out, from the beginning). They will.

They are not supposed to. If we had good judges in office who understood the history, words and intent of the Constitution, the ethics and backbone, most of the unconstitutional laws would be struck down in court, and the system would work as intended and setup.

But it doesn't.

The article I linked to, and other articles on that site are correct in an academic sense. By that I mean that they are technically correct - but as the arguments don't work in court, much less Congress, be the judicial system is more concerned about precedent than first principles. The Congress on the other hand is not concerned about either, being more concerned with the principle of the ends justifying the means - the ends, being their agenda and their power.
 
When the Einsatzgruppen stuff the door behind full auto with fire support from a helicopter, it doesn't much matter what you think about the constitutionality of it.
