Not yet, but the version of the rule I read (before being put on the register - I have not read the one in the register, yet), has started referring to these "firearms" as "pistol grip shotguns", saying that is common for the ATF "experts" to refer to them that way. Since this is how they think of these firearms, I would not be surprised if a future ruling tries to change the legal definition of these to an SBS.
 
Isn't the ATF the enforcement agency and not the legislative (law writing) branch of the government?
The Chevron deference (SCOTUS1984, Chevron v. Natural Resources Defense Council) was a court ruling that states that a government agency can interpret a statute with a lot of leeway, and write the regulations as they see fit. West Virginia v. EPA (SCOTUS 2022) poked some holes in the 1984 ruling and some are pursuing that avenue.
