The usual actors are horrified that Cody Wilson will be allowed to distribute files under the deal he recently reached with the DOJ. They are also being a bit disingenuous when they say that the deal makes no sense because Wilson and Defense Distributed have so far lost at every step of the legal process. The case that was recently settled was not based on the substantive issue of whether prohibiting file sharing of one's own work was a prior restraint of protected speech, rather, it was on whether a preliminary injunction should have been granted to Wilson such that he would be allowed to distribute files while the case proceeded through trial. One reason for not granting the injunction was that Wilson waited a long time to file the suit (he probably needed money) but in waiting so long, he couldn't say he was going to suffer immediate irreparable harm because the harm.

Winning a preliminary injunction is usually harder than winning the actual case because you are asking the courts to guess at what the ultimate facts will be. The effect of the 5th Circuit decision against Wilson, was that the case was to be remanded to the trial court to finish the fact gathering process and then issue an ultimate ruling. And on that issue, even the judges ruling against Wilson had this to say:

Judge Davis concluded his opinion on a somewhat ominous note for the State Department: "On remand, the district court eventually will have to address the merits, and it will be able to do so with the benefit of a more fully developed record. The amicus briefs submitted in this case were very helpful and almost all supported Plaintiffs-Appellants' [meaning Wilson's] general position."

3D-Printed Guns Hit the Courts

So the settlement reached here doesn't actually look like a situation where a party who was winning just inexplicably gave up. It looks like a settlement from a party which knew it was ultimately going to lose, faced reality, and decided to stop wasting money.
 
All this panic shows who they really want to disarm. The individual. As if the terrorists and drug dealers who smuggle tons of narcotics some how cannot get guns without 3D printer files.
Are they blatantly dishonest or just stupid? YES, yes they are. Trying to deny tools to violent people with no self examination of why there are violent people. 15220741313691693015686001.png
