To see how it works, let's first set aside situations where you may not use deadly force for self-defense regardless of whether you're in a stand your ground state:

  1. You generally can't use deadly force for self-defense in most states unless you reasonably believe that you're facing the risk of death or serious bodily injury or some serious crime: rape, kidnapping or, in some states, robbery, burglary, or arson.
  2. In particular, you can't use deadly force purely in retaliation, once any threat has passed.
  3. Nor can you use deadly force against a simple assault, unless you reasonably believe that you're facing the risk of death or serious bodily injury.
  4. You often can't use deadly force merely to protect property, but it's complicated.
  5. You generally can't use deadly force where you are yourself engaged in the commission of a crime (e.g., if you're robbing someone and he fights back, you can't "defend" yourself against him).
  6. You generally can't use deadly force if you attacked the victim or deliberately provoked the victim with the specific purpose of getting the victim to attack or threaten you.




Now let's set aside situations where you may use deadly force for self-defense, again regardless of whether you're in a stand your ground state:

  1. You reasonably believe that you're facing the risk of death etc. (see above) and you can't retreat with complete safety. This would cover most situations where, for instance, you're facing an attacker who has a gun, since one generally can't safely retreat from a gun.
  2. You reasonably believe that you're facing the risk of death etc. and you're in your home, or (in some states) on other property that you own or in your vehicle or in your workplace. At least the "home" aspect of this is often called the Castle Doctrine, on the theory that your home is your castle.

I've always disliked the "need to retreat in the face of crime" laws. The criminal breaks into YOUR home, YOU are then forced to retreat until the CRIMINAL has you cornered, pinned, or trapped, and then, and ONLY then, are you allowed to defend yourself! WTHeck!

THIS is what's wrong with American law! A criminal breaks in, THE CRIMINAL should be afraid the homeowner/user will kill them and/or beat them bloody, not the other way around! But the power structure NEEDS a certain amount of crime on the streets to maintain power and keep the sheeple under control. What would happen if criminals were shot and killed breaking and entering, raping and murdering, running wild in the streets, burning and looting?! Why the billion dollar industries like courts, prisons, jails, etc. would collapse from lack of slave labor!

This happened in a city about 30 miles away: a blm thug in a stolen car was driving over lawns, running over mailboxes, tearing up bushes and trees until the car got stuck/broke down. Then it started breaking into houses (it was a dead-end street) down one side of the street, either kicking down doors or breaking windows, roming around and then leaving and starting over at the next house. When it got to the last house on that side it went across the street and started over. After tearing a hole in the garage door, it went into the house where it told the homeowner it was going to rape his wife and daughters in front of him, then kill everyone. The homeowner finally shot and killed the blm thug (no police could be bothered to show up when it was going on/being reported as it was a blm thug of course, even though this was a "good" area. Not rich, but a decent area and low crime). The so-called "press", especially the TV idiots, went batsnot on this!

An evil White Supremist homeowner shot a poor defenseless blm thug! The Horror! The Horror!! How dare he defend his wife and children! Then details started leaking out, "well...um... we reported that...well that was a lie...er...ah... inaccurate....and in fact...um...er...ah...we...um...lied about,... er... misreported that..." Of course the homeowner having his house (it isn't "news" in any meaningful use of the word) on the TV 24/7 (well, more like 24/3 before all the lies started to be exposed), and then it dropped off the babbling head cycle completely! "Break ins? Shooting? Blm rapist-thug with a long string of felonies? Stolen car? Why we have no idea what you are talking about!" Typical.

Then one drug dealer downtown saw another drug dealer on who was on the 1st dealer's "turf" and claimed the other drug dealer "flashed a gun at him when he pulled up his shirt" and the 1st opened fired on a crowded street mall. Claimed "stand your ground" as a defense, and opened fire "because the other drug dealer was on his turf and since it was HIS 'turf' HE had a 'right' to be there selling drugs and to protect it!"

I was laughing my rear off! Two protected class felon drug dealers having a shoot out (well, OK, only one was ever proven to be emptying a magazine into the crowd of bystanders), with illegal handguns, and claiming "stand your ground" as "it was HIS drug turf and the other dealer invaded and flashed a gun at him!" How would the White liberal idiots who love blm/drug dealers/felons/criminals in general handle that? Well, self-preservation won out I guess, because they convicted the drug dealer with drug possession, illegal gun, shooting up the crowd (can't remember if anyone was hurt or not, but none seriously anyway. Thank God for holding the gun sideways and blazing away wildly), and probably a few other things. Don't know what he got, but here? Probably 30 days, less if he didn't act like an idiot in jail.

I keep saying there should not be "bad areas" where honest citizens are afraid to go, there should ONLY be whole towns and cities where criminals are afraid to go! I seem to remember a bank robbery where the whole town turned out and shot the James Gang of outlaws to pieces! Now? if the town turned out and shoot them up today, the town would be sued into bankruptcy and the citizens would end up in prison! And THAT is what is wrong with Amerikan law today!

Who called the police? Bad guy gets shot committing a crime, too bad. Good reason to turn around and walk away. Do not engage law enforcement without a lawyer. Do not try to "explain" anything. Most people in prison put themselves there, because they would not shut the hell up.
