While technically it was an accident there should to be some sort of negligent legal aspect to this. The mother was shot in the head because the barrel was pointing in her direction by the hand holding the gun. I agree we have little information to go on and there could be other extenuating circumstances but there was essentially no reason for the gun to be pointing in the direction of the mother's head and the trigger to be pulled at the same time. I did not see it in the story but in one of the comments it was mentioned this happened at 2 AM and if that is true then other possibilities exist such as drugs or alcohol being involved.
