I'd like to open carry, but I ride a motorbike. I do have a CCL if that makes any difference.

Is there a statute or ordinance that would prohibit my open carry while in transit on motorbike? Anyone know?

I have heard that it might be an issue up in the woods during hunting season (Not sure what I'd be hunting with a scandium .357 1 5/8th snubbie, but i have heard it may be something an LEO could get me for...

Please advise if you know the official answers.

Thank you,

Todd

Carrying on a motorcycle open or concealed is fine with a CHL. There is no law prohibiting you from carrying without a hunting license and DFW can't make rules restricting your ability to carry firearms, only rules about taking game. This is because of state preemption and the legislature hasn't granted the power for departments to make those rules.

The ODFW site seems down at the moment but I have this link from earlier. Hope it works later. http://www.dfw.state.or.us/resources/hunting/big_game/regulations/weapons.asp

Also you can carry with a CHL off road. That change is pretty recent.

821.240 Operating snowmobile or all-terrain vehicle while carrying firearm or bow; exemptions; penalty. (1) A person commits the offense of operating a snowmobile or an all-terrain vehicle while carrying a firearm or bow if the person operates any snowmobile or all-terrain vehicle with a firearm in the possession of the person, unless the firearm is unloaded, or with a bow, unless all arrows are in a quiver.
(2) Subsection (1) of this section does not apply to a person who is licensed under ORS 166.291 and 166.292 to carry a concealed handgun.
(3) As used in this section, "unloaded" means:
(a) If the firearm is a revolver, that there is no live cartridge in the chamber that is aligned with the hammer of the revolver;
(b) If the firearm is a muzzle-loading firearm, that the firearm is not capped or primed; or
(c) If the firearm is other than a revolver or a muzzle-loading firearm, that there is no live cartridge in the chamber.
(4) The offense described in this section, operating a snowmobile or an all-terrain vehicle while carrying a firearm or bow, is a Class B traffic violation.

ETA: Deleted a bunch of legal info because I missed the mention of a CHL

is the CHL Oregon or California? If its issued in California it will be of no effect in Oregon

True. My post assumes it is an OR CHL. If not, then OC on a belt holster is still alright as long as the motorcycle is not being operated off-road.

thanks for the clarification. I am an oregon Resident, but I'd like to be able to carry in Ca in case I cross the border to hit the coast or the redwoods. Can I carry at all in N cal (even openly) or is it totally verboten?

I don't know much about CA laws. I know they cracked down on unloaded open carry a couple years ago. There is a discussion here and it looks like its up to the county in a lot of places. http://forum.opencarry.org/forums/s...ornia-National-Forests-now-that-AB-144-is-law
