Under Title X of the Patient Protection and Affordable Care Act...

Section 2717 of the Public Health Service Act, as added
by section 1001(5) of this Act, is amended—
(1) by redesignating subsections (c) and (d) as subsections
(d) and (e), respectively; and
(2) by inserting after subsection (b), the following:
‘‘(c) PROTECTION OF SECOND AMENDMENT GUN RIGHTS.—
‘‘(1) WELLNESS AND PREVENTION PROGRAMS.—A wellness
and health promotion activity implemented under subsection
(a)(1)(D) may not require the disclosure or collection of any
information relating to—
‘‘(A) the presence or storage of a lawfully-possessed
firearm or ammunition in the residence or on the property
of an individual; or
‘‘(B) the lawful use, possession, or storage of a firearm
or ammunition by an individual.
‘‘(2) LIMITATION ON DATA COLLECTION.—None of the
authorities provided to the Secretary under the Patient Protection
and Affordable Care Act or an amendment made by that
Act shall be construed to authorize or may be used for the
collection of any information relating to—
‘‘(A) the lawful ownership or possession of a firearm
or ammunition;
‘‘(B) the lawful use of a firearm or ammunition; or
‘‘(C) the lawful storage of a firearm or ammunition.
‘‘(3) LIMITATION ON DATABASES OR DATA BANKS.—None of
the authorities provided to the Secretary under the Patient
Protection and Affordable Care Act or an amendment made
by that Act shall be construed to authorize or may be used
to maintain records of individual ownership or possession of
a firearm or ammunition.
‘‘(4) LIMITATION ON DETERMINATION OF PREMIUM RATES OR
ELIGIBILITY FOR HEALTH INSURANCE.—A premium rate may not
be increased, health insurance coverage may not be denied,
and a discount, rebate, or reward offered for participation in
a wellness program may not be reduced or withheld under
any health benefit plan issued pursuant to or in accordance
with the Patient Protection and Affordable Care Act or an
amendment made by that Act on the basis of, or on reliance
upon—
‘‘(A) the lawful ownership or possession of a firearm
or ammunition; or
‘‘(B) the lawful use or storage of a firearm or ammunition.
‘‘(5) LIMITATION ON DATA COLLECTION REQUIREMENTS FOR
INDIVIDUALS.—No individual shall be required to disclose any
information under any data collection activity authorized under
the Patient Protection and Affordable Care Act or an amendment
made by that Act relating to—
‘‘(A) the lawful ownership or possession of a firearm
or ammunition; or
‘‘(B) the lawful use, possession, or storage of a firearm
or ammunition.''.

It's great somebody advocated for gun rights and got an Amendment put in there. I'll bet it was a struggle. What Big Brother giveth he can taketh away someday.
What is the definition of the lawful use, possession, or storage of a firearm or ammunition going to be when the mental health of an ACA patient visited in the home does not conform to the ACA standards? Will Anti-Govt. thoughts equal mental illness, parinoia?
 
The other thing I read in the text was that (under section 2951) it states that the home visits are voluntary. One is only "eligible" to accept visitation if they meet the "high risk" criteria. I was a little spooked at first until I read into the text. It sounds pretty benign as it reads. Although anything can be abused. It seems to be (again based on the text in sec 2951) that the focus on the home visitation is the well being of childhood development and pre natal care of mothers and unborn children as well as lactation consultation for breast feeding mothers. Although I will add that with 1000 pages of legalese a lot can get by a lay person such as myself. I recommend that anyone who is truly concerned link to the PDF that I posted in my previous comment and formulate your own opinion. With all the unknowns with this healthcare reform it will be interesting to see how the chips fall. Oh, that reminds me. I have seen concern elsewhere regarding the "CHIP" program being "implanted microchip mandate". According to the ACA "CHIP" is an acronym that stands for Child Heath Insurance Plan. Just a side note. Be well all and stay out of the Docs office! LOL!
 
They are going to take it slow at first so as not to spook anybody just to "GET THEIR FOOT IN THE DOOR" so to speak. It will all seem harmless and reasonable at first but give it a few years. VOLUNTARY home health visits/inspections will be required as a stipulation to receive services for family members in need. Lifestyle recommendations will morph into mandatory requirements with the authority to remove anyone who doesn't comply in the name of safety and health.
They will eventually have a monopoly on healthcare and you or a member of your household getting ill will mean relinquishing your Fourth Amendment rights!

I think it may have more to do with military suicides outnumbering combat deaths recently. Ex-military kill themselves about one every hour. That sounds high-risk to me.

  • Families with a current or former member of the armed forces. Oh yeah our Govt supports our troops
  • Families with a history of child abuse or neglect.

Just wait. If this goes into effect, they will start to expand the list by fiat as they see fit.

I can go you one better in my grandfathers Cavalry records his middle name until 1934 was Adolf after 1934 it was Alfred and in 1939 it became "A" and was never expanded to a full name again until he died in 1978. He served from 1927 until 1953 US mounted Cavalry and US Army from Mar 17 1942 on.

Obamacare Contains Forced Inspection provision in Obamacare provides millions of dollars in annual funding for State inspectors to conduct forced visits on homes with what the government deems is “high-risk” behaviors.

Among the high-risk behaviors listed are:

Families residing in communities identified by States as needing services to improve parenting and improved child care.
Low-income families.
Families with a pregnant woman or girl under age 21.
Families with a history of substance abuse.
Families containing tobacco users.
Families with children with low student achievement.
Families with children with disabilities.
Families with a current or former member of the armed forces.
Families with a history of child abuse or neglect.
So the Federal government is going to pay for an army of social workers to visit homes looking for “unapproved” high-risk behavior. Two items on the list are especially disquieting because, when combined with a 2006 Health and Human Services publication Child Neglect: A Guide for Prevention, Assessment, and Intervention, we learn that inspectors conducting a risk assessment are to take note of firearms in the home.

The information compiled during forced inspections will be logged into a database. Database information can them be used to mandate behavioral changes or to identify weapons owners, leading to a confiscation of firearms.

Constitutional attorney and author Kent Masterson Brown states: “This is not a voluntary program. The eligible entity receiving the grant for performing the home visits is to identify the individuals to be visited and intervene so as to meet the improvement benchmarks. A homeschooling family, for instance, may be subject to intervention in school readiness and social-emotional developmental indicators. A farm family may be subject to intervention in order to prevent child injuries. The sky is the limit.”

Guys. You forgot to apply the Obama-supporter logic to this thread that we see whenever someone questions an administration policy or direction. Let me give it a try.

Wow. It is really hard to write stuff that is so delusional. I started arguing with myself as I was typing.

I’m really surprised that we haven’t seen action taken with FHA, VA, Fannie Mae and Freddie Mac to make condition of home loan approval contingent on surrender of firearms. Call me paranoid but what can’t be done at the ballot box or in congress is being done one chip at a time by “policy”.

Up in my neck of the woods they have people at Walmart asking folks to sign petitions for stricter background checks. All for the sake of keeping guns out of the hands of criminals.

The guy was offended when I refused to sign his petition.
