    Default Rock Creek homeowner is alive instead of being another victim

    Washington County Sheriff's Office On Monday, October 4, 2010, at about 7:18 p.m., Sheriff’s deputies responded to a 911 call at 5425 NW Ridgmoor Court in the community of Rock Creek. A woman reported that her son, 39-year-old James Sartor, was tearing up her house and she needed help. Mr. Sartor had been released from the Washington County Jail earlier in the evenin...g. He had been arrested over the weekend for Criminal Trespass 2 and Disorderly Conduct 2 for entering the Greek Village Tavern (301 NW Murray Boulevard, in the Community of Mill Creek) after being trespassed previously from the bar. He also threatened to assault one of the employees of the bar, but did not harm anyone.

    On October 4, Mr. Sartor left his mother’s house before deputies arrived. He was on foot and did not have access to a car. Deputies searching the neighborhood were notified that dispatch had received at least one call of a suspicious man walking through the same neighborhood in the area of NW Quail Hollow Drive and NW Edgebrook Place.

    While the deputies were responding to the second call, a third call came in from the 5300 block of NW Edgebrook Place. The homeowner reported that a man was trying to break into his house and the homeowner had a gun. Before the deputies arrived at the home, the homeowner shot the intruder who had broken a large bay window in order to gain access to the house. Mr. Sartor was shot while entering the house through the window. Sheriff’s deputies arrived within a minute of the shooting and took Mr. Sartor into custody. He was later transported to an area hospital with non-life-threatening injuries. He had been shot in the leg.

    Sheriff’s detectives are investigating the case and have not arrested the homeowner. A Grand Jury will hear the case in the near future to determine charges against Mr. Sartor and to determine whether the homeowner will face any charges.

    Mr. Sartor is currently being treated at OHSU. When he is released, he will be arrested on charges related to the October 4 incident.


    **The discussion needs to be what reward/medal to give the homeowner, not whether to press charges. And maybe give him some target practice... in the leg??

    If someone stuck there leg through my window on the way in to my house, I would of shot it more than once.
    Not to say this is how it went, for the home owner.
    Just sayin.

    No reward or medal. The homeowner did a piss-poor job since the suspect lived. He should be happy enough if he gets away with no charges.

    He did what the law allows; stop the threat! Why take someone's life (even a bad guy) if it's not necessary?

    I read in another article that the homeowner stated he didn't want to kill the intruder. Leads me to believe he may have shot him in the leg on purpose.

    what was the threat?,probable cause?sartor breaking a window?there was no real threat listed,in chl class they teach you what a threat is,and merely breaking a window without a potential life threatening weapon involved,or show of superior force,this homeowner now faces a real threat!

    Two years later this guy gets out of prison. All throughout his two year tenure in MCCF he's been thinking about you. He burns your house to the ground while you are sleeping. Never jerry rig a problem, fix it permanently.

    He didn't just allegedly break the window, he was allegedly gaining access or had already entered the home. Someone breaks into your house and what would you do? Ask them if they want some tea and crumpets?

    unfortunately i cant write laws.oregon doesnt support the castle doctrine rule,as far as i know.look it up

    I listened to an interview with the homeowner on the Lars Larson show yesterday. The homeowner stated that he had pushed the intruder (who had picked up a large metal lamp stand and was hitting owner and his wife) back out the window once then the intruder came back in again. The owner deliberately shot the intruder "low". The intruder fell out the window and was lying on the ground. The owner kept him at gunpoint till the police arrived. The owner said that if the guy had tried to get back up at that point he would "dropped him for good". Now get this! When the police commanded the owner to drop his weapon (which he did immediately) he put it behind him and the intruder then lunged to get the pistol! The home owner pushed him back and his wife picked up the gun.

    A shame they are even thinking about any charges against the home owner.This is why we need a castle doctrine.You break into a home you leave in a bag.I ain't got time to ask the intruder after he breaks into my home if he has good non life threatening intentions.

    However, Oregon does NOT require you to retreat before defending yourself. I did look that up!

    Check the law. You don't have to retreat from your home which is pretty much the same as a "Castle" law and you DO have the right to use deadly force if the intruder has any weapon.

    You are listed as WA but since this event occured in OR I will cite OR law:

    161.219 Limitations on use of deadly physical force in defense of a person. Notwithstanding the provisions of ORS 161.209, a person is not justified in using deadly physical force upon another person unless the person reasonably believes that the other person is:

    (1) Committing or attempting to commit a felony involving the use or threatened imminent use of physical force against a person; or

    (2) Committing or attempting to commit a burglary in a dwelling; or

    (3) Using or about to use unlawful deadly physical force against a person. [1971 c.743 §23]


    The bad guy having a weapon is not a requirement per the statute.

    Civil liablity is another story.

    sounds like the homeowner had a legit reason to shoot the idiot,assuming what he said is true.best of luck to him!
